"To the Question of the Sources of Old Russian Law: Concept and Typology"

Abstract

The article analyzes the concept of "source of law" in relation to the ancient Russian period, specifies the chronological framework of the concept of "source of ancient Russian law". Based on the study of theoretical approaches, as well as the real state of historical knowledge about Old Russian law, the author comes to the conclusion that this concept should be used in three meanings: in the material (the will of the powerful subjects of legal relations), formal (the external expression of this will), source study (written historical sources where information about legal regulations was reflected). The author defines the chronological framework for the creation of sources of Old Russian law in the formal sense of the word from the 10th to the middle of the 13th century, and also, based on these data, gives a typology of sources of Old Russian law in all three meanings.
